Acceptance of Terms

By accessing and using BallisticEngine ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. We reserve the right to update these terms at any time — continued use after changes constitutes acceptance.

Description of Service

BallisticEngine is an educational physics simulation tool that calculates theoretical projectile penetration into various materials using mathematical models (Poncelet, Johnson-Cook, Mohr-Coulomb, and others). The Service includes a web-based calculator, an ammunition and weapons database, and educational blog articles.

Educational Purpose Only

The Service is provided for educational, academic, and research purposes only. All calculations, simulations, and data are theoretical approximations based on simplified mathematical models. They do not constitute professional engineering advice, safety assessments, or material specifications.

Specifically, you acknowledge that:

Results are approximations with stated error margins (±3% to ±25% depending on material) and should not be used as the sole basis for engineering decisions, safety assessments, architectural design, structural analysis, or any application where human safety is at stake.

Material properties in the database represent typical published values and may differ significantly from specific real-world samples due to manufacturing variance, age, environmental exposure, moisture content, and other factors.

Ammunition data is sourced from manufacturer specifications and may not reflect actual performance in specific firearms, barrel lengths, temperatures, or conditions.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. We do not warrant the accuracy, completeness, or reliability of any calculations, data, or content provided through the Service.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BALLISTICCALC, ITS OPERATORS, CONTRIBUTORS, OR DATA PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING FROM:

Your use of or inability to use the Service; any reliance on calculations, simulations, or data provided by the Service; any decisions made based on information from the Service; unauthorized access to or alteration of your account or data; any third-party content, products, or services accessed through the Service.

Acceptable Use

You agree to use the Service only for lawful purposes. You agree not to:

Use the Service to plan, facilitate, or carry out any illegal activity; attempt to gain unauthorized access to the Service, its servers, or any related systems; use automated scripts, bots, or crawlers to access the Service beyond reasonable personal use; interfere with or disrupt the Service or servers; impersonate any person or entity; use the Service in any manner that could damage, disable, or impair the Service.

User Accounts

Certain features require a free account. By creating an account, you agree to provide accurate information and maintain the security of your login credentials. You are responsible for all activity under your account.

We reserve the right to suspend or terminate any account that violates these Terms, engages in abuse, or poses a security risk, without prior notice.

You may delete your account at any time. Account deletion is permanent and irreversible. Upon deletion, all associated data is removed in accordance with our Privacy Policy.

Paid Services

If you subscribe to a paid plan ("Pro"), you agree to pay all applicable fees. Payments are processed through Stripe. Subscriptions automatically renew unless cancelled before the renewal date. Refunds are handled on a case-by-case basis.

We reserve the right to change pricing with 30 days notice to existing subscribers.

Intellectual Property

The Service, including its design, code, physics models, database structure, and original content, is protected by copyright and intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without explicit written permission.

Ammunition and weapon specifications in the database are factual data sourced from publicly available manufacturer specifications and are not claimed as proprietary.

Third-Party Services

The Service uses third-party infrastructure including Cloudflare (hosting), Supabase (database and authentication), and Google Fonts (typography). Your use of the Service is also subject to the terms and privacy policies of these providers.

Indemnification

You agree to indemnify, defend, and hold harmless BallisticEngine and its operators from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

Governing Law

These Terms are governed by and construed in accordance with the laws of the European Union (GDPR) and applicable local laws. Any disputes shall be resolved through good-faith negotiation first, and if necessary, through the courts of competent jurisdiction.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
